MyFunded Futures LLC, and each of their affiliates (collectively, "MFF," "we," "us," "our") respects your privacy and is committed to protecting the information we hold about you. This Privacy Notice explains our practices with respect to information we collect and process in connection with your relationship with us. This includes information we collect through, or in association with, our website with a home page located at https://myfundedfutures.com, together with all services we may offer from time to time via our website, social media sites, mobile apps, or otherwise through your interactions with us (collectively, the "Services").

MFF's European Union representative is DataRep, located at The Cube, Monahan Road, Cork, T12 H1XY, Republic of Ireland. This Privacy Notice further explains the manner in which the MFF collects, uses, and maintains Personal Data of individuals based in the UK and the EU, as required under the General Data Protection Regulation 2016/679 ("GDPR") or the GDPR and the Data Protection Act 2018, as applicable.

By using any of our Services and/or by voluntarily providing us with your data, you acknowledge that you have read and understand the practices contained in this Privacy Notice. What Information Do We Collect?

We collect certain information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household ("Personal Data") through the Services, including:

  • When you provide it to us directly by creating an account or subscribing to the Services;
  • Automatically through logging and analytics tools, cookies, pixel tags, and as a result of your use of and access to the Services; and
  • From third-party sources, including service providers, such as IP2Location, Fingerprint JS, Riseworks, and SumSub.

You have choices about certain information we collect. When you are asked to provide information, you may decline to do so; but if you choose not to provide information that is necessary to provide any aspect of our Services, you may not be able to use those Services. In addition, as noted below in the section captioned "Your Choices" it is possible to change your browser settings to block the automatic collection of certain information.

Finally, we may collect data that is not identifiable to you or otherwise associated with you, such as aggregated data, and is not Personal Data. To the extent this data is stored or associated with Personal Data, it will be treated as Personal Data; otherwise, the data is not subject to this Privacy Notice.

Information You Share With Us

We collect Personal Data from you when you provide it to us, including through creating an account through the Services, undergoing a verification process in order to comply with financial regulations, connecting a bank account, or contacting us with questions or comments. For example, if you create an account to use the Services, we may collect your name, phone number, email address, physical address, billing address and company information.

To proceed with the verification process, we may require that you provide additional personal data (including your date of birth, driver's license or passport, proof of address, and social security number) sufficient to conduct a background screening for Anti-Money Laundering (AML) and Know Your Client (KYC) purposes.

If you are applying for a role with us, including certain temporary or consulting roles, we may also collect personal data about you from other sources such as your current employer, employees and colleagues or through publicly available internet searches. Information Collected Automatically or Indirectly from You

When you browse or use the Services, we utilize commonly-used logging and analytics tools, including Google Analytics and Vercel Analytics, to collect information about your use of the Services (such as how you navigate and move around the Services).

We also use cookies to personalize and enhance your experience with our Services, to collect data about your visit to our Services, to help diagnose problems with our servers, to administer the Services, and to gather broad demographic information about our users.

Information collected automatically includes the software and hardware attributes of the device you use to access the Services, unique device ID information, regional and language settings, performance data about the Services, network provider, and IP address (a number assigned to your device when you use the Internet). In addition, information is collected passively in the form of log files that record website activity. For example, log file entries and analytics data are generated every time you visit a particular page on our website, and track the dates and times that you use the Services, the pages you visit, the amount of time spent on specific pages, and other similar usage information, and general data (including the name of the web page from which you entered our website).

Information Obtained from Third Parties

We receive Personal Data from third parties that we have engaged to provide services to us, such as payment processors, our security vendors, and other third parties from time to time. For example we us Plaid Inc. ("Plaid") to gather your data from financial institutions. Please review Plaid's Privacy Policy for more information regarding how Plaid uses your Personal Data.

We may also use financial institutions to process ACH funds transfers from your funding source bank account when you use of our Services.

Legal Bases for Processing

We process Personal Data for, or based on, one or more of the following legal bases:

  • Your Consent. We may process your information if you have provided us with consent to use your Personal Data for a specific purpose. You have the right to revoke your consent at any time.
  • Performance of a Contract. We may process Personal Data to enter into, or perform under, the agreement between us.
  • Legitimate Interests. We may process Personal Data for our legitimate interests, including servicing your account; providing information about our products and/or services; to the extent necessary and proportionate for the purposes of ensuring network and information security; and for administrative, fraud detection, and legal compliance purposes.
  • Compliance with Legal Obligations and Protection of Individuals. We may process Personal Data to comply with the law and our legal obligations, as well as to protect you and other individuals from certain harms.

How Do We Process Personal Data?

Operational Uses

We process Personal Data as part of our operations, which include:

  • Providing you with information tailored to your requests, responding to inquiries, and delivering services and products
  • Operating, maintaining, and improving the quality of the Services and such content, products and/or services as we may make available through the Services
  • Communicating with you by email and text message (SMS, MMS), in each case with your consent, if such consent is required in accordance with applicable laws
  • Debugging to identify and repair errors that impair existing intended functionality
  • Undertaking internal research for technological development and demonstration
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity
  • Compliance with applicable laws, regulations, rules, and requests of relevant law enforcement and/or other governmental agencies, including for KYC and AML purposes
  • To enforce our Terms and Conditions
  • Endeavoring to protect our and our partners' rights, property, or safety, and the rights, property, and safety of our users and other third parties
  • For other purposes, as permitted or required by law

Sharing of Personal Data

Some of the above processing involves sharing Personal Data with third parties, including service providers and other partners.

  • We share Personal Data with third parties when you authorize us to do so to effectuate transactions and provide the Services;
  • We share Personal Data with certain affiliated third parties;
  • We share Personal Data with our service providers, including our banking and payment processors, background check providers, and other vendors we engage so that they may provide services to us or on our behalf; and
  • We share Personal Data with government agencies or regulators when permitted or required to do so by law; in response to a request from a law enforcement agency or authority or any regulatory authority; and/or to protect the integrity of the Services or our interests, rights, property, or safety, and/or that of our users and others.

Your Rights Regarding Personal Data

You have certain rights regarding the collection and processing of Personal Data. You may exercise these rights, to the extent they apply to you, by contacting us at the information provided at the end of this Privacy Notice, or by following instructions provided in this Privacy Notice, or in communications sent to you.

Accessing, Modifying, Rectifying, and Correcting Collected Personal Data

We strive to maintain the accuracy of any Personal Data collected from you, and will try to respond promptly to update our records when you tell us the information in our records is not correct. However, we must rely upon you to ensure that the information you provide to us is complete, accurate, and up-to-date, and to inform us of any changes. Please review all of your information carefully before submitting it to us, and update your account with any changes or corrections.

Depending on the laws that apply to you, you may obtain from us certain Personal Data in our records. If you wish to access, review, or make any changes to Personal Data you have provided to us through the Services, please contact us at the information provided at the end of this Privacy Notice. We reserve the right to deny access as permitted or required by applicable law.

Your California Privacy Rights

California's "Shine the Light" law permits our users who are California residents to request and obtain from us a list of what Personal Data (if any) we disclosed to third parties for their own direct marketing purposes in the previous calendar year and the names and addresses of those third parties. Requests may be made only once per year per person, must be sent to the email address below, and are free of charge. Requests may be sent through the contact methods listed below.

Your Nevada Privacy Rights

Nevada law permits our users who are Nevada consumers to request that their Personal Data not be sold (as defined under applicable Nevada law), even if their Personal Data is not currently being sold. Requests may be sent through the contact methods listed below.

Your Other US Privacy Rights

If you are located in Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah and Virginia, you have certain rights regarding your Personal Data. The section describes how we collect, use, and share your Personal Data under the Colorado Privacy Act, the Connecticut Act Concerning Personal Data Privacy and Online Monitoring, the Delaware Personal Data Privacy Act, the Iowa Consumer Data Protection Act, the Montana Consumer Data Privacy Act, the Nebraska Data Privacy Act, New Hampshire SB 255, New Jersey SB 332, the Oregon Consumer Privacy Act, the Texas Data Privacy Act, the Utah Consumer Privacy Act, and the Virginia Consumer Data Protection Act, and your rights with respect to that Personal Data.

As a Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah or Virginia resident, you have some or all of the rights listed below. However, these rights are not absolute, and we may decline your request as permitted by law. You can ask to appeal any denial of your request in the same manner through which you may submit a request. Accordingly, you may have the following rights with respect to your Personal Data, including to:

  • Right to Access and Portability. You have right to access your Personal Data and/or receive a copy of the Personal Data that we have collected about you.
  • Right to Correct. You have the right to correct inaccurate or outdated Personal Data that we have collected about you.
  • Right to Delete. You have the right to delete the Personal Data we have obtained about you or that you have provided to us with certain exceptions.
  • Right to Opt-out of Tracking for Targeted Advertising Purposes. You have the right to opt-out of certain tracking activities for targeted advertising purposes.
  • Right to Opt-out of Profiling. If we process your Personal Data for profiling purposes as defined by the applicable state privacy law (other than the ICDPA), you can opt-out of such processing.
  • Right to Non-discrimination. If you exercise any of your consumer rights, you have the right to be treated the same as a consumer who does not exercise any rights.
  • Right to Opt-out of Sales. You have the right to opt out of the sale of your Personal Data to third parties.
  • Right to Opt-in for Sensitive Data Processing. To the extent we process any of your sensitive Personal Data (as defined under applicable State law), you have the right to opt-in before we can process any such data.
  • Right Against Automated Decision-making. You have the right to opt out of certain automated decision-making about you.

Your Canadian Privacy Rights

Residents of Canada are permitted to request and obtain from us information respecting the existence, use, and disclosure of their Personal Data as well as access to that information (subject to certain exceptions pursuant to applicable laws). Without limiting the above, residents of Canada will, upon request:

  • Be informed of whether we hold Personal Data about you;
  • Be provided with an account of third parties to which we have disclosed your Personal Data;
  • Be able to challenge the accuracy and completeness of your Personal Data and have it amended as appropriate; and
  • Be provided with information about our policies and practices with respect to the management of Personal Data, including: the name or title, and address, of the person who is accountable for our privacy policies and practices; the means of gaining access to Personal Data; a description of the type of Personal Data held by us, including a general account of its use; a copy of any brochures or other information that explain our policies, standards, or codes; and what Personal Data is made available to related organizations.

Your EU, UK and Swiss Privacy Rights

If you are located outside the United States, we transfer Personal Data for processing in the United States, including Personal Data sent via e-mails or when you make an order. Under the GDPR, we are considered a "controller" of the Personal Data. By using the Services outside the United States, you acknowledge that we will transfer your data to, and store your Personal Data in, the United States, which may have different data protection rules than in your country, and Personal Data may become accessible as permitted by law in the United States, including law enforcement and/or national security authorities in the United States. For transfers of data into and out of the EEA, Switzerland, and the UK, pursuant to Article 46 of the GDPR, we use standard contractual clauses adopted by the European Commission or applicable regulator.

Under the GDPR, you may have the following rights with respect to your Personal Data, including to:

  • Right to Access and Portability. You have right to access your Personal Data and/or receive a copy of the Personal Data that we have collected about you in a portable format.
  • Right to Object to Processing. You have the right to object to the continued processing or use of your Personal Data.
  • Right to Correct. Right to update and correct inaccuracies in your Personal Data.
  • Right to Object. Right to object to the continued processing or use of your Personal Data in certain situations, including for direct marketing.
  • Right to Erasure. Right to have the Personal Data blocked, anonymized, or deleted, as appropriate in certain situations.
  • Right to Complain. You have the right to complain to a supervisory authority, and your Personal Data may be blocked, anonymized, or deleted, as appropriate. If you are in the EU, you may find information about your supervisory authority here and if you are in the UK, you may find it here.
  • Right to Withdraw Consent. If you have provided us with a consent to use your Personal Data you have a right to withdraw that consent easily at any time. Please contact us to do so. Withdrawing a consent will not affect the lawfulness of our use of your Personal Data in reliance on that consent before it was withdrawn.

Please understand, however, that we reserve the right to retain an archive of such Personal Data for a commercially reasonable time to ensure that its deletion does not affect the integrity of our data; and we further reserve the right to retain an anonymous version of such Information.

You may withdraw consent from receiving marketing and promotional communications by clicking the "Unsubscribe" link on the communication or sending an e-mail to with the subject line "Opt Out." If European Data Subjects do not provide Personal Data to us or withdraw consent for processing such Personal Data, we may not be able to provide such individuals with certain features or functionalities of the Services or information regarding the Services, including processing.

Marketing

We may use your Personal Data to send you updates about our services. We have a legitimate interest to use your Personal Data for marketing purposes. This means we do not usually need your consent to send you marketing information. However, where consent is needed, we will ask for this separately and clearly.

Our websites also collect certain information automatically and store it in log files by using cookies and other automated technologies. For more information on our use of cookies, please see Section 13 below.

If you do not wish to be contacted by us, you can follow the unsubscribe instructions that accompany any marketing e-mail or contact us using the details outlined in section 16 below. If you opt-out of such communication, we may still contact you about any problems or issues with your account, profile, or any services provided by us. We will always treat your personal data with respect and will never sell or share it with other organizations outside our group for marketing purposes.

Protecting Personal Data

We use reasonable and appropriate physical, technical, and organizational safeguards designed to promote the security of our systems and protect the confidentiality, integrity, availability, and resilience of Personal Data. Those safeguards include: (i) the encryption of Personal Data where we deem appropriate; (ii) taking steps to ensure Personal Data is backed up and remains available in the event of a security incident; and (iii) periodic testing, assessment, and evaluation of the effectiveness of our safeguards.

However, no method of safeguarding information is completely secure. While we use measures designed to protect Personal Data, we cannot guarantee that our safeguards will be effective or sufficient. In addition, you should be aware that Internet data transmission is not always secure, and we cannot warrant that information you transmit utilizing the Services is or will be secure.

Retention of Personal Data

We retain Personal Data as long as you are using the Services, and as well as to the extent we deem necessary to carry out the processing activities described above, including but not limited to compliance with applicable laws, regulations, rules and requests of relevant law enforcement and/or other governmental agencies, and to the extent we reasonably deem necessary to protect our and our partners' rights, property, or safety, and the rights, property, and safety of our users and other third parties.

Your Choices

You have choices about certain information we collect about you, how we communicate with you, and how we process certain data. When you are asked to provide information, you may decline to do so; but if you choose not to provide information that is necessary to provide some of our Services, you may not be able to use those Services. In addition, it is possible to change your browser settings to block the automatic collection of certain information.

Communications Opt-Out

You may opt out of receiving communications from us at any time through a given communications channel by following the opt-out link or other unsubscribe instructions provided in any email message received, by contacting us as provided at the end of this Privacy Notice. If you wish to opt out by sending us an email to the address provided below, please include "Opt-Out" in the email's subject line, and include your name and the email address you used to sign up for communications in the body of the email.

Automated Decision Making

MFF does not engage in automated decision making for processing the Personal Data it collects.

Other Important Information About Personal Data and the Services

Children

Persons under 18 years of age are not permitted to use the Services, and we do not knowingly collect information from persons under the age of 18. By using the Services, you represent that you are 18 years of age or older.

Business Transfer

We may, in the future, sell or otherwise transfer some or all of our business, operations or assets to a third party, whether by merger, acquisition or otherwise. Personal Data we obtain from or about you via the Services may be disclosed to any potential or actual third-party acquirers and may be among those assets transferred.

International Use

Your Personal Data will be stored and processed in the US, UK and the European Union EU. If you are using the Services from outside the US, by your use of the Services you acknowledge that we will transfer your data to, and store your Personal Data in, the US, which may have different data protection rules than in your country, and Personal Data may become accessible as permitted by law in the US, including to law enforcement and/or national security authorities in the US.

Former Clients

If you decide to close your account(s) or become an inactive customer, we will disconnect your account from any subscription activity, and will adhere to this Privacy Notice, which may be amended from time to time, in connection with Personal Data that we retain.

Modifications and Updates to this Privacy Notice

This Privacy Notice replaces all previous disclosures we may have provided to you about our information practices with respect to the Services. We reserve the right, at any time, to modify, alter, and/or update this Privacy Notice, and any such modifications, alterations, or updates will be effective upon our posting of the revised Privacy Notice. Your continued use of the Services following our posting of any revised Privacy Notice will constitute your acknowledgement of the amended Privacy Notice.

Applicability of this Privacy Notice

This Privacy Notice is subject to any agreements, including our Sim Funded Agreement, Live Trader Agreement and other agreements that govern your use of the Services. This Privacy Notice applies regardless of the means used to access or provide information through the Services.

This Privacy Notice does not apply to information from or about you collected by any third-party services or websites linked from the Services, which we use to gather Personal Data from financial institutions,. Any such collection or receipt of Personal Data is subject to those third parties' privacy policies and terms of use, and under no circumstances are we responsible or liable for any third party's compliance therewith.
